TERMS AND CONDITIONS OF USE

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE EARLY LEARNING AND CHILD CARE REGISTRY:

The Early Learning & Child Care Registry is owned by the Government of Prince Edward Island and https://peichildcareregistry.com/ is owned by The Early Childhood Development Association of Prince Edward Island (the “Association”). The Early Learning & Child Care Registry and https://peichildcareregistry.com/ (collectively the “Registry”) are both operated by the Association. The use of Registry is subject to the following terms and conditions (the “Terms and Conditions”) of use, as amended from time to time. The Terms and Conditions are to be read together with any terms, conditions or disclaimers provided in the pages of the Registry. The Terms and Conditions apply to all users of the Registry and by accessing and using this Registry, you accept and agree to be bound by and comply with the Terms and Conditions. If you do not accept these Terms and Conditions, you must not access or use the Registry. If you are dissatisfied with the Terms and Conditions, or any rules, policies, guidelines or practices of the Association, your sole and exclusive remedy is to discontinue using the Registry.

The Government of Prince Edward Island and the Association reserve the right to make modifications to the Registry and Terms and Conditions without notice,including changing, suspending or termination any services provided through the Registry or imposing additional terms and conditions on the use of the Registry. You agree to review these Terms and Conditions regularly and by continuing to access and use this Registry, you accept and agree to any changes. You agree that the Association will not be liable to you or any other party for any change, suspension or termination of any service provided by the Association or Registry.

Registration

If you choose to register with the Association through the Registry, you agree, represent and warrant that you will:

  • provide true, accurate, current and complete information as prompted by any registration functions on the Registry; and
  • maintain and promptly update any information to keep it true, accurate, current and complete at all times.

If you provide any information that is untrue, inaccurate, not current or incomplete, or if the Association has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, the Association shall have the right to suspend or terminate your account and any or all privileges on the Registry and to refuse any and all current or future use of the Registry.

The Association’s use of any personal information you provide as part of the registration process is governed by the terms of the Association’s Privacy Policy.

Accounts

If you choose to register with the Association through the Registry, you will receive a username and password for your account through the Registry’s registration process.

You are not permitted to allow anyone else to use your account, nor are you permitted to use anyone else’s account. You must keep your account password secure and you must not provide it to anyone else, except an authorized Association representative. You agree to immediately notify the Association if you suspect there has been unauthorized use of your account or any other breach of the security of your account. You are solely responsible for any use or misuse of your account or password and for all activity that occurs using your account. The Association will not be liable to you or to any third party for any authorized or unauthorized use of your account.

You acknowledge and agree that the Association may access and/or disclose your account and related information if required to do so by law or if the Association has reasonable belief that such actions are reasonably required to:

  • comply with legal obligations imposed on the Association;
  • enforce or fulfill these Terms and Conditions; or
  • protect the rights, property or safety of the Association, other users and/or the general public.

All accounts remain the property the Association and may be cancelled or suspended at any time by the Association without any notice or liability to you or any other person.

Active and Inactive Accounts

Once you register with the Association through the Registry, registered individuals are responsible for ensuring their account remains active in order to maintain their account and positions on any waitlists. Registered Centres are also responsible for ensuring their account remains active in order to maintain their account and listing on the Registry.

To maintain an active account, a registered individual is required to log in to their account at least every ninety (90) days. If a registered individual’s account has been inactive for ninety (90) days, the Registry’s automated system will send the following notifications to the email address and/or telephone number provided by the registered individual:

  • After ninety (90) days of inactivity an email and/or text message will be sent to advise the registered individual that they must log in to their account;
  • After an additional fourteen (14) days of inactivity an additional email and/or text message will be sent to advise the registered individual that they must log in to their account; and
  • After an additional fourteen (14) days of inactivity a final email and/or text message will be sent to advise that the registered individual’s account has been closed.

Once a registered individual’s account is closed the child's or children’s names will be removed from any waitlists on the Registry.

To maintain an active account, a registered Centre is required to log in to their account at least every sixty (60) days. If a registered Centre’s account has been inactive for sixty (60) days, the Registry’s automated system will send the following notifications to the email address and/or telephone number provided by the registered Centre:

  • After sixty (60) days of inactivity an email and/or text message will be sent to advise the registered Centre that they must log in to their account;
  • After an additional fourteen (14) days of inactivity an additional email and/or text message will be sent to advise the registered Centre that they must log in to their account; and
  • After an additional fourteen (14) days of inactivity a final email and/or text message will be sent to advise that the registered individuals account has been closed.

Once a registered Centre’s account is closed the Centre’s listing and contact information will be removed from the Registry.

Use and Restrictions

You are permitted to use the Registry for your own personal, non-commercial purpose. Use of any automated system or software to extract data from the Registry for commercial purposes is prohibited. Additionally, you agree that you will not:

  • take any action that imposes or may impose (to be determined in the Association’s sole discretion) an unreasonable or disproportionately large load on the Association’s infrastructure;
  • interfere or attempt to interfere with the proper working of the Registry, or any activities conducted on or with the Registry; or
  • bypass any measures the Association may use to prevent or restrict access to the Registry.

The use of the Registry is governed by all related guidelines, policies, regulations and legislation. If you fail to comply with any guidelines, policies, regulations or legislation relating, the Association shall have the right to suspend or terminate your account and any or all privileges on the Registry and to refuse and any all current or future use of the Registry.

Indemnification

You agree to defend, indemnify and hold harmless the Association, its affiliates, representatives, officers, agents, contractors and employees against any losses, liabilities, claims, expenses (including attorney’s fees and court costs), demands, threats, actions or proceedings in any way arising from, related to or in connection with your use of the Registry including in connection with any services offered through the Registry, your violation of the Terms and Conditions or any applicable law or regulation, or the posting or transmission of any materials on or through the Registry by you, including but not limited to, any third party claim that any information or materials provided by you infringe upon any third party proprietary rights.

Compliance with Laws

In addition to complying with these Terms and Conditions, you agree to use the Registry and the Association’s materials for lawful purposes only and in a manner consistent with local, national or international laws and regulations. Some jurisdictions may have restrictions on the use of Internet by their residents.

Potential users of the Registry in any jurisdiction of the world whose laws (common, statutory, regulatory or codified) would:

  • void these Terms and Conditions in whole or in any essential part (the essential parts being at least, but not only, the provisions relating to the governing law and limitation of liability); or
  • render accessing the Registry illegal

are not authorized to use the Registry.

Disclaimer

The use of the Registry is at your sole risk and you assume full responsibility for any costs or losses associated with your use of the Registry. The Association will not be liable for any damages of any kind related to the use of the Registry.

Warranty Disclaimer

The information found on the Registry is provided as a public service by the Association. The Registry and all of the information it contains is provided strictly “as is” and without warranty of any kind, either expressed or implied.

We cannot guarantee that all information is current or accurate. Every effort is made to ensure the accuracy, currency and reliability of the content. At any time, some details may not yet reflect recent changes.

Limitation of Liabilities

Under no circumstances will the Association be liable to any person or business entity for any direct, indirect, special, incidental, consequential, or other damages based on any use of this Registry or any other website to which this site is linked, including, without limitation, any lost profits, business interruption, or loss of programs or information.

External Websites

The Association makes no warranties, guarantees or representations about any external website it references, and it will assume no responsibility or liability for any loss or damage sustained due to any inaccuracy or misinformation found at such an external website.

Waiver

The Association’s failure to exercise or enforce any right or provision of these Terms and Conditions will not constitute a waiver of such right or provision. A waiver by the Association of any default will not constitute a waiver of any subsequent default. No waiver by the Association is effective unless it is communicated to you in writing.

Headings

Any headings and titles herein are for convenience only.

Severability

If any of the provisions of these Terms and Conditions are determined to be invalid, unlawful or unenforceable, such provision will to that extent be severed from the remaining Terms and Conditions, which will continue to be valid and enforceable to the fullest extent permitted by law.

Governing Law

Any disputes arising out of or relating to the Terms and Conditions or use of the Registry or the Association’s services will be resolved in accordance with the laws of the Province of Prince Edward Island. Any disputes, actions or proceedings relating to the Terms and Conditions, or your access or use of the Registry must be brought before the courts of the Province of Prince Edward Island and you irrevocably consent to the exclusive jurisdiction and venue of such courts.

AGREEMENT/CONFIMRATION WHEN APPLYING TO CENTRE(S)

In particular, I understand that in completing this application to the selected centre(s), the personal information that is associated with this account will be forwarded to the selected centre(s) and will be used by the centre(s) for the purpose of placing the child/children on the waiting list(s), communicating information in relation to the placement of a child/children at the centre(s), and offering spaces at the centre(s) to the child/children. Further, I understand that the Early Childhood Development Association of Prince Edward Island does not control and is not responsible for the collection, use and disclosure of my personal information once it is provided to the centre(s).
